HCJ 2901/02 – HaMoked: Center for the Defence of the Individual et al. v. IDF Commander in the West Bank Petition for Order Nisi and Interim Order

Petition by HaMoked and other human rights organizations to allow detainees at the Ofer military camp to meet with their attorneys. The petition was filed during "Operation Defensive Shield" when mass arrests residents of the Territories were taking place. The detainees were held at Offer. The petition was filed after the Petitioners received information regarding torture and violence toward the detainees and harsh holding conditions in the camp and after the Petitioners' request to stop the use of these means and allow representatives of human rights organizations and attorneys to enter the camp went unanswered. An order forbidding meetings with attorneys was not presented to the Petitioners and it was clear that no one examined each detainee individually to determine that he must be prevented from meeting with a attorney as required by law.
