HCJ 2901/02 – HaMoked: Center for the Defence of the Individual et al. v. IDF Commander in the West Bank Petition for Order Nisi and Interim Order

The HCJ rejected a petition to allow detainees arrested in the mass arrests of "Operation Defensive Shield" and held at the Ofer camp to meet with their lawyers. The Petitioners received information regarding torture and violence toward the detainees in the camp and the harsh holding conditions therein. The HCJ ruled that it is unthinkable that the Respondent would allow people who may pose a threat to the security of the area, the military or the public to meet with their lawyers, so long as conditions are not right for weighing the individual circumstances of each detainee. Therefore, the HCJ chose not to intervene in the sweeping order issued by the Respondent forbidding detainees from meeting with their lawyers.
