In a letter to the Central Command dated 29 November 2006, HaMoked demands the immediate nullification of the OC Central Command's order prohibiting Israelis driving an Israeli vehicle from transporting a person who is not Israeli, for the most part Palestinians, within the West Bank, without permission to do so from an army officer or someone authorized by him. Behind the declared security rationale for the aforementioned order, HaMoked claims, lies a cynical motive, the purpose of which is to advance the policy of ghettoization of the West Bank, and an attempt to restrict the work of Israeli and foreign human rights organizations with Palestinians whose rights are violated as a result of the occupation of the West Bank, and by means of this to create a social, cultural and political barrier between populations.
HaMoked asserts that the new order discriminates against Palestinians on an ethnic and/or racial basis and is contrary to the fundamental ruling of the High Court of Justice (HCJ) which explicitly prohibits discrimination against any group on the basis of, among other things, sex, religion, nationality, and race. The order is also clearly contrary to international law, and especially the International Convention on the Elimination of All Forms of Racial Discrimination, the International Convention on the Suppression and Punishment of the Crime of Apartheid, the International Covenant on Civil and Political Rights, and the Rome Statute of 1998. It should be noted that if the order is not nullified immediately, HaMoked will consider legal proceedings.
