The state contends that it is justifiable and legal to keep the location of Facility 1391 a secret, that such secrecy does not infringe the detainees’ rights, and is not grounds to close it. According to the state, the location is kept secret for legitimate, security reasons – there is a real fear that disclosure of the location will cause grave harm to state security. Also, the state argues, the purpose of the relevant statutory provisions does not obligate it to disclose the location. Its response is supported by the affidavit of “Johnny", the commander in charge of the facility.
