HCJ 9733/03 HaMoked: Center for the Defence of the Individual v. State of Israel et al. Request to Respond to Respondents’ Response to Petitioner’s request for Submission of Document

HaMoked’s response to the state’s objection to the submission of the concluding observations of the UN Committee against Torture regarding Facility 1391 to the petition filed against it. HaMoked is bewildered by the state’s claim regarding irrelevance when the committee’s sessions addressed the exact subject matter of the petition. HaMoked stresses that the state’s representatives who were present at the committee sessions were given the appropriate venue to voice their position. The state’s claim regarding the lack of secrecy of Facility 1391 is also perplexing considering that this is the very issue disputed in the petition. HaMoked also expresses concern over the overt disrespect shown by the state to the work of the UN committee charged with the application of the international Convention against Torture, by which the state is bound.
