Petition by HaMoked against the decision not to permit a family that resides in the West Bank, but was living against their will in Gaza, to return to the West Bank. The petition also deals with the army’s policy of preventing all Palestinians registered as residents of the Gaza Strip to move to the West Bank, and from Palestinians registered as residents of the West Bank to move to Gaza. This policy is implemented without authority and violates the law in the Occupied Territories, as well as the respondents’ consistent position that the West Bank and the Gaza Strip constitute a single territorial unity, a position that is set forth in Israeli case law.
