HCJ 1520/09 - Jabarin v. Commander of the Army Forces in the West Bank Petition for Order Nisi

A petition to allow the director general of the Palestinian human rights organization Al-Haq to travel to the Netherlands in order to participate in the ceremony for the awarding of the prestigious Geuzen medal to his organization. The petitioner, who to this day has never been summoned for an interrogation regarding the suspicions raised against him, has submitted three petitions against the travel ban. The petitions were all rejected based on "confidential material" presented to the judges; no hearing was held for the petitioner, in which he could have defended himself. The petitioner claims that the ban on his travel abroad is a violation of his freedom of movement, is disproportionate and unreasonable, and constitutes a violation of Israeli law, international humanitarian law, and human rights law.
