HCJ 1585/10 Hamdallah et al. v. Military Commander in the West Bank Petition for Order Nisi

HaMoked’s petition to instruct the military to allow a Palestinian attorney from the Ramallah district to travel to Jordan en route to PhD studies. The petitioners stress that his indictment for transferring funds to an Islamic Jihad affiliated office assisting prisoners during representation of detainees in military courts has also been deleted. The military’s non detailed refusal to allow him to leave for his studies is disproportionate and infringes, inter alia, on his right to freedom of movement and to education. In refusing, the military commander breaches his duty under international humanitarian law to ensure the normal lives of the protected residents in the occupied territory under his control.
