HCJ 6615/11 - Salhab et al. v. Minister of Interior Petition for Order Nisi

HaMoked’s petition to instruct the Minister of Interior to automatically enable Palestinians whose family unification applications are approved and who reside in Israel pursuant to stay permits to work and earn a living in Israel. HaMoked argues that by not including a work permit in these stay permits and by subjecting their holders to a process for issuing work permits to West Bank residents, the Minister of Interior is violating their right to dignity, a livelihood, equality and freedom of occupation. HaMoked argues that this violation serves no legitimate purpose, does not meet the proportionality test and must be invalidated.
