HCJ 9594/03 - B’Tselem et al. v. Judge Advocate General Updated Statement on Behalf of the Respondent

Statement by the State Attorney's Office in a petition seeking a MPIU investigation be opened into every death of a Palestinian civilian uninvolved in hostilities in the OPT caused by the military. The State Attorney's Office requests to dismiss the petition as rendered moot. It announces the Military Advocate General's recent decision to open an investigation in any future civilian death due to military activity in the West Bank, except "when it is clear" the activity was "of real combat nature". It further states that following the political changes in the Gaza Strip, the legal situation has changed and "it is unjustified to open a criminal investigation in every case where an uninvolved civilian is injured" by military activity.
