HCJ 11198/02 - Diriya et al. v. Commander of the Ofer Military Detention Facility et al. Decision

Decision in HaMoked's petition concerning three Palestinians held in the Ofer military detention facility who do not receive family visits. The court rules that there is no reason for issuing an order nisi in the petition given that the state does not dispute the right of inmates to receive family visits and has even announced its intention to arrange visits from certain areas in West Bank and from additional areas later on. The court, however, decides to leave the petition pending in order to examine the progress of expanding visiting arrangements to further areas and the visits to the Ofer facility, situated in the West Bank, independent of the International Committee of the Red Cross.
