HCJ 1891/10 - Jarbo et al. v. West Bank Military Commander et al. Petition for Order Nisi

HaMoked's petition to instruct the military to permit the passage of a family from Gaza to the West Bank. The family's father was accidentally expelled from the West Bank to Gaza, where he started a family. HaMoked emphasizes that the state itself admits that the decision to expel the man to Gaza contradicted the military's own procedures, as he is registered as a resident of the West Bank; it is therefore unreasonable for the state to continue harming him even after acknowledging its mistake and approving his request to return to the West Bank. HaMoked further claims that, by deciding not to approve the transfer of the entire family to the West Bank, Israel is harming the man's right to family life, and essentially barring him from returning to the West Bank.
