In accordance with the request of the Court in the proceedings in HCJ 9169/07, HaMoked has filed an updating notification regarding holding conditions and duration in the military temporary detention facilities: In its update, HaMoked emphasizes that holding conditions in the temporary detention facilities must be improved substantially. The state should properly undertake to transfer detainees from the temporary detention facilities within a period of no more than eight days

HaMoked has published a position paper calling for the rejection of bills that seek to deny the right to family visits to security prisoners who are members of organizations holding Israeli captives: HaMoked argues that these proposed laws are inconsonant with international and Israeli law; violate Israel’s obligation to protect the right to family life and its commitment – in accordance with the Geneva Convention – to provide detainees with the conditions they deserve, regardless of the principle of reciprocity

After the expiry of the sixty-day period set by the court, at the state’s request, for the state to file its response in HaMoked’s petition regarding the authorities’ failure to respond to requests, HaMoked has now filed an application for an order nisi: Surprisingly, the High Court of Justice (HCJ) asked to receive the state’s response “as soon as possible,” without setting any date and without criticizing the State Prosecutor’s Office, which habitually fails to meet deadlines set by the court

At a hearing held on 29 November 2007, the court criticized the behavior of the state and the military regarding the holding of detainees in incarceration facilities in the West Bank: In its petition HaMoked demanded that a clear procedure be published concerning the duration of time in which detainees may be held in temporary incarceration facilities. The petition also demanded that the military be ordered to provide detainees with incarceration conditions consonant with international law

HaMoked responds to the State's position in its petition to have the IPS accurately record where detainees are being held. HaMoked clarifies a number of inaccuracies in the State's response: For example, the State refers to a procedure which does not reflect the facts described in the petition and claims it has done nothing wrong, that there are very few cases where detainees have not been registered and that these are a result of prison overload

The Court ordered the military and the Israeli Prison Service (IPS) to respond to a petition filed by HaMoked and explain why the IPS does not record the facility in which detainees are held and the destination to which they are transferred in real time: This following a Habeas Corpus petition filed by HaMoked in order to reveal the whereabouts of a detainee who had been transferred from the Kishon prison to an unknown destination. The IPS did not notify the detainee’s family and made no record of the transfer, contrary to requirements

Following a tort claim filed by HaMoked, the Jerusalem Magistrate Court ordered over a million NIS in damages to the family of a Palestinian prisoner who was brutally beaten to death by fellow inmates: The Court determined that the State and the prison authorities were negligent in their task to protect the Deceased after failing to take reasonable measures to prevent his death

Thanks to intervention by HaMoked, women from the West Bank whose registered address is in the Gaza Strip will be able to visit their sons in jail and return home: After the visits themselves were approved, the wardens threatened to send the women back to Gaza on buses. In subsequent visits they retracted this threat following a letter from the Legal Advisor for the West Bank
