HCJ 9657/07 - Jarbo'a et al. v. Commander of the Army Forces in the West Bank Petition for Order Nisi

HaMoked's petition to permit a Palestinian and her four children passage from Gaza to Israel, in order to travel to the West Bank. The petitioner wishes to visit her children from a previous marriage, who live in Qalqiliya and whom she has not seen since 2005. The only stated reason for the State's refusal is that the request "does not fit criteria". HaMoked claims that the respondents must guarantee the petitioners' normal life, pursuant to international law. HaMoked also claims that by refusing, Israel injures the petitioners' right to family life and freedom of movement. The petitioners stress that they only wish to pass through Israel, and that by prohibiting passage the respondents are violating their right of transit. The petition was rejected.
