HCJ 9657/07 - Jarbo'a et al. v. Commander of the Army Forces in the West Bank Judgment

The HCJ rejects HaMoked's petition regarding entry to Israel for the purpose of passage from Gaza to the West Bank. The petitioner requested a permit for herself and her children, in order to travel from the Gaza Strip to the West Bank through Israel, and visit her children from a previous marriage who live in the West Bank. In an unreasoned judgment the Court accepted the respondents' claim that passage from Gaza to the West Bank should be prohibited due to the current security situation. Furthermore, in a perplexing, precedential ruling, the Court stated that the petitioner "has no inherent right to enter Israel for any purpose, including passage to the Judea and Samaria Area."
