HCJ 6138/10 - HaMoked: Center for the Defence of the Individual v. Attorney General Preliminary Response on Behalf of the Respondent

Response to HaMoked’s petition to instruct the Attorney General to examine complaints of torture during ISA interrogations in an efficient and timely manner and to formulate a procedure for such examination, ascertaining, inter alia, that complaints are not ignored. The State apologizes for the significant delay in reaching decisions, but argues that the petition must be rejected since these decisions were ultimately reached and since, on the issue of the procedure, there was no exhaustion of remedies. The State finally notifies that examination of complaints by ISA interrogees will be fully transferred to the Ministry of Justice.
