HCJ 8070/14 - Abu Jamal et al. v. GOC Home Front Command Response on behalf of the Respondent

The state's response to HaMoked's petition against the military's intention to partially demolish the family home of one of the two assailants in the attack at the synagogue in Har Nof, Jerusalem. The state claims that "due to the wave of terror attacks in Jerusalem in recent months [...] deterring terrorists who are East Jerusalem residents from carrying out attacks inside the country is vital"; more so given that some were "'lone terrorists' [...] willing to die in the execution of the attack". The state also maintains that as the court has previously rejected HaMoked's argument that house demolition constitutes collective punishment in severe violation of the rights of innocent people, there is no call to address it again.
