HCJ 5034/09 - Nababteh et al. v. GOC Southern Command Petition for Order Nisi

HaMoked’s petition to allow a Jerusalem resident and her family members to enter Gaza to participate in the weddings of her sisters who reside there. HaMoked submitted an application to allow their entry to Gaza months before the dates of the weddings, but the appeals received no substantive response. In its petition HaMoked stresses that by ignoring the petitioner’s application, the State violates her right to freedom of movement and family life, and stresses the State’s obligation to act as an administrative authority. The Court rejected the petition and accepted the State’s claims regarding the security risk emanating from the petitioner’s relatives.
