HCJ 5034/09 - Nababteh et al. v. GOC Southern Command Application by Consent to Submit a Response on behalf of the Petitioners

HaMoked’s response in a petition to allow a resident of Jerusalem to enter Gaza in order to participate in her sisters’ weddings. In the response, HaMoked wonders why the State is harming the petitioner despite the fact that the security risk is attributed to her second degree relatives. HaMoked stresses that infringing on the liberty of person who poses no risk is necessarily disproportionate.
