HCJ 5034/09 - Nababteh et al. v. GOC Southern Command Respondent's Preliminary Response

The State’s response to HaMoked’s petition to allow a Jerusalem resident and her family to enter Gaza in order to participate in her sisters' weddings. The State claims that according to the security agencies, the petitioner’s second degree relatives are involved in activities against Israel, and therefore her entry to Gaza must not be permitted. The State repeats its claims that currently, an Israeli resident has no right to enter Gaza, by force of the Implementation of the Disengagement Plan Law. The State also claims that there is a concern that Israelis entering Gaza for a visit will be exploited by terrorists.
