HCJ 6475/07 - Abu a-Laban et al. v. OC Southern Command et al. Response on behalf of the Respondents

Respondents' response to HaMoked's petition to allow a Palestinian physician from Gaza to travel to Egypt to resume studies for a Master's in obstetrics and gynecology. The response provides a factual description which is, at best, inaccurate and misleads the court. While the Respondents claim the Petitioner cannot travel as the crossing is closed, in fact, Erez is regularly open for movement in both directions, sometimes without prior coordination.  Despite the Respondents' objections and the fact that the petition was dismissed, the military approved Petitioner's travel to Egypt.
