HCJ 6475/07 - Abu a-Laban et al. v. OC Southern Command et al. Judgment

The Court rejects a petition by a Palestinian physician from Gaza to travel to Egypt via Erez and Allenby Bridge. The judgment , based on misleading factual arguments by the Respondents, was rendered without a hearing. Rendering a judgment in this manner is an exceptional measure reserved for petitions that do not show prima facie cause and mostly taken in the rare cases of vexatious, baseless petitions. The Petitioner ultimately received the sought remedy despite the judgment and the Respondents' objections, after the military approved her request.
