HCJ 726/08 - Al 'Adlouni et al. v. Commander of the IDF Forces in the West Bank Preliminary Response on behalf of the Respondents

The State’s response to HaMoked’s petition to allow four minor children to travel from Gaza to the West Bank to be with their father and ailing mother whom they have not seen in five months. The State claims the petitioners are attempting to exploit their grave situation to “relocate” to the West Bank, since the mother’s condition does not make it necessary that she remain in the West Bank. The State adds that if and when it is presented with medical documents indicating an unequivocal medical need for the mother’s presence in the West Bank, it would be willing to allow the children to travel, on the condition that the mother pledge to return too Gaza with her children once her treatment is concluded, and obtain temporary permits which will be periodically reviewed. Following HaMoked’s petition, the children were able to travel to the West Bank.
